Ask David: AI Coaching Assistant

1. About This Service

Ask David is an AI coaching assistant trained on the work, frameworks and methodologies of Professor David Clutterbuck. It is operated by DeepQuery Ltd (“DeepQuery”) on behalf of Clutterbuck Coaching and Mentoring International (“CCMI”).

By subscribing to or accessing Ask David, you agree to be bound by these Terms of Service. Please read them carefully before using the service.

2. Subscription, Billing and Renewal

Ask David is provided on a paid monthly subscription. By subscribing:

• You may choose the Text plan (£25 per month) or the Voice + Text plan (£45 per month). Prices include applicable taxes unless stated otherwise.
• Your subscription renews automatically each month until you cancel.
• Payment is taken at the start of each billing period by our payment provider, Stripe. We do not store your card details.
• You can cancel at any time from your account settings. Your access continues until the end of the period you have already paid for, after which it will not renew.
• Except where required by law, payments are non-refundable for partial billing periods.
• We will give you reasonable advance notice by email of any change to your subscription price; changes take effect from your next renewal.

3. Usage Allowance

Your allowance depends on your plan:

• Text: unlimited text-based conversations with the assistant.
• Voice + Text: unlimited text-based conversations, plus two (2) hours of voice conversation per month.

On the Voice + Text plan, when your monthly voice allowance is used up, the voice feature will be unavailable until it resets at the start of your next billing month. Text messaging remains fully available throughout.

4. Important Notice: What This Service Is Not

Please read this carefully.

Ask David is an AI assistant trained exclusively on David Clutterbuck's published works and frameworks. It is designed as a professional development and practice tool for coaches, HR professionals, team managers and business leaders.

Ask David is not:

• A substitute for professional coaching, mentoring, supervision or business advice
• A qualified therapist, counsellor or mental health professional
• Able to replace the judgement of a trained human coach in complex or sensitive situations

AI can make mistakes. Always apply your own professional judgement when interpreting responses. If you or someone you are working with is in crisis or requires immediate support, please contact an appropriate professional or emergency service.

5. Eligibility

By using Ask David, you confirm that:

• You are at least 18 years of age
• You will use the platform for legitimate purposes in accordance with these Terms

6. Acceptable Use

You agree to use Ask David only for lawful purposes. You must not:

• Use the platform to generate harmful, abusive, discriminatory or illegal content
• Attempt to manipulate or jailbreak the AI assistant
• Use the platform to impersonate David Clutterbuck or misrepresent AI-generated content as David Clutterbuck's personal views
• Share, reproduce or commercially exploit AI-generated responses without prior written consent from CCMI
• Attempt to extract, reverse engineer or replicate the underlying AI model, knowledge base or voice clone
• Use the platform in any way that could damage the reputation of David Clutterbuck or CCMI
• Share your account or access with any other person

7. Voice and Data Consent

By using this platform, you consent to:

• The recording, processing and storage of your voice and written messages sent via this platform during sessions
• Your conversations being reviewed by CCMI representatives for quality assurance purposes and platform development
• Any feedback you provide on individual AI responses being recorded and used to improve the platform
• Your usage data being used to improve the platform

If you do not consent to your conversations being recorded and reviewed, please do not use this service.

8. Data Retention

While your subscription is active, your account and conversation history are retained so you can resume your conversations. If you cancel, your account and associated conversation data are retained for 30 days and then permanently deleted, unless you resubscribe within that window.

You may request deletion of your data at any time. See our Privacy Policy for full details, including retention periods and your rights.

9. Intellectual Property

All content generated by Ask David is derived from David Clutterbuck's intellectual property, which remains the exclusive property of CCMI and David Clutterbuck. DeepQuery owns all platform code, architecture and technical systems.

You may use AI-generated responses for your own professional development and learning purposes. You may not reproduce, publish or commercially exploit AI-generated responses without prior written consent from CCMI.

10. Disclaimer of Warranties

The platform is provided “as is”. DeepQuery and CCMI make no warranties, express or implied, regarding:

• The accuracy, completeness or suitability of any AI-generated response
• The availability or continuity of the service
• The fitness of the platform for any particular professional purpose

11. Limitation of Liability

To the maximum extent permitted by law:

• Neither DeepQuery nor CCMI shall be liable for any indirect, consequential or loss of profit claims arising from your use of the platform
• Our total aggregate liability is limited to the amount you have paid for the subscription in the twelve (12) months preceding the claim

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.

12. Termination

DeepQuery reserves the right to suspend or terminate your access, with notice where reasonably practicable, if:

• You breach these Terms of Service
• You misuse the platform or engage in unacceptable use as defined in clause 6
• Payment for your subscription fails and is not resolved

You may cancel and stop using the platform at any time from your account settings. To request deletion of your data, contact help@deepquery.dev.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to you via email before taking effect. Continued use of the platform following notification constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
